den blir man imidlertid ikke særlig mye klokere av. Den må være en av verdens
mest kaotiske og uoversiktlige grunnlover Den har bestemmelser om alt mulig
rart som ikke hører hjemme i en grunnlov, unntak fra bestemmelsene og unntak
fra unntakene osv. Det som imidlertid er klart er at islam er statsreligion,
men i prinsippet har andre religioner også visse rettigheter. Islam gis
imidlertid en særstilling. Alle ikke-muslimske trossamfunn må ha godkjenning
fra myndighetene for å bygge kirker, templer osv, men tilsvarende regler
gjelder ikke når muslimer vil bygge moskeer. I motsetning til mange andre
muslimske land har Malaysia ikke dødsstraff for frafall fra islam, men en muslim som går
over til en annen religion kan straffes med bøter og fengsel for
”rehabilitering”.
Den 21 juli 2004 falt det
imidlertid en dom i Malaysias føderale høyesterett, en dom som er meget
illevarslende for religionsfriheten i landet, i den grad det i det hele tatt
kan snakkes om religionsfrihet i et muslimsk land. Fire frafalne muslimer hadde
reist en sak for domstolen for å få dens medhold i at de hadde rett til selv å
velge hvilken religion de ville bekjenne seg til. De fikk IKKE medhold:

like to add my two cents on this emigration issue. I belong to a category of
Malaysians who are considering emigrating due to the government's refusal to
recognise my personal conscience and religious freedom. To put it in bluntly,
I am what Islam would define as an 'apostate'. After the recent Federal Court
ruling on the apostasy case, it seems that I would be in legal limbo
indefinitely. I
challenge Dr G Walter and Shaukat Ali to educate me on what other alternative
I have other than to emigrate. If I am not allowed to choose freely the
religion that I believe in and be legally recognised for it but instead be
constantly harassed socially and legally in Malaysia, the only practical
thing is to leave Malaysia. Or maybe, perhaps I might just be some rubbish to
say good riddance to? For the
record, I am not a convert to Islam who has had second thoughts. I was born a
Muslim and decided to convert to another religion as a matter of personal
conviction. |
Konklusjonen som denne innsenderen trekker er
vel i og for seg logisk nok. Kan han ikke praktisere den religion han tror på i
Malaysia har han ikke stort annet å gjøre enn å emigrere til et annet land.
Spørsmålet er hvor ikke-muslimer til slutt skal gjøre av seg etter hvert som
denne kreftsvulsten som oppsto på menneskeheten i Arabias ørken for ca 1400 år
sprer seg. Det er bare et spørsmål om tid før vi har tilsvarende tilstander i
Norge, dvs på sett og vis har vi det allerede. Muslimer i Norge som forsøker å
skifte religion trues på livet og må ofte leve i skjul. Talsmenn for muslimer
er i TV-debatter gjentatte ganger blitt konfrontert med at islam forkynner
dødsstaff for frafall, og de benekter det ikke.
I et annet leserinnlegg forsøker en kvinnelig
muslim å bortforklare at roten til problemet ligger i islams lære, og i stedet

Apostates

recently came across a website where purported apostates from Malaysia told
their stories. I am a Singaporean and a proud Muslimah and reading the
postings on that website has led me to the conclusion that Malaysian
apostates are more angry with the Malaysian
government than they are with Islam. I feel that they think Islam is the
problem but only on the way Malaysia bases its policy with regards to it. I
have engaged some of these apostates on the website and have been trying hard
to show them that it is not Islam that has wronged them but people using
Islam as an excuse to impose their will. I am not
writing to you to champion the apostates’ cause. I am only doing this so that
the Malaysian government may consider reviewing their policy. In Singapore,
people can renounce their religion as and when they like it and there is no
pressure to practice one belief. It is wrong to force one to hold on to a
religion that one doesn't believe in and this it contradicts the claim that
Islam is not about force. Malaysian apostates, however, have confused themselves
as to who or what is actually oppressing them and in some way, they have
linked this to Islam. While I
respect the Malaysian government of trying to execute Islamic law as well as
they can, I think punishing apostates is not relevant anymore. After all,
Malaysia doesn’t stone to death Muslims caught for adultery, does it? If that
can be overlooked, why not apostasy? I think that there is a ‘hadith’ saying
that whenever we see or know a person of misconduct, we should first use all
the authority we have to stop him or her, and if that fails then we have to
talk to them and advise them, and if that too fails then we pray for them. Malaysia
has imprisoned and counselled its apostates but if they still choose to
remain apostates then I think it is time for government to let them live
their life. Let me stress here that I am not condoning or encouraging
apostasy. But I think one should be given the choice to practise one’s
beliefs. Forcing religion down somebody’s throat won't achieve the aim of
having good Muslims and Muslimahs - this will only cause hate and contempt
towards Islam. Remember, ‘God guides whom He pleases to the right path’. |

to the letter Apostates angry with Islam or government? I, for
one, am aware of the website that Shairul Fazleena is referring to. Although
she asserts that she is not endorsing the apostates' cause, let us state here
very clearly that her suggestion that the Malaysian government should
‘review’ their policy with regard to apostates is tantamount to mocking the
Deen itself. It is
without a doubt that apostasy is a very serious offence in Islam, and there
are no ‘ifs’ and ‘buts’ about it. However, individuals like Shairul are from
the flock of ‘liberal Muslims’ who prefer to abandon the Qur'an and Sunnah
injunction with regard to apostates in favour of their ‘values’ from the West
concerning freedom of religion. True,
Islam does espouses the freedom of religion (Quran,
2:256). Freedom of religion, however, is not to be confused with freedom
to simply leave the religion and put the Muslim ‘ummah’ in jeopardy. Let's put
it this way. Singapore is not Malaysia. If Muslims in Singapore want to
tolerate apostasy at their whim and fancy, it is their business. That they
are so far apart from the practice of Islam speaks for itself.
Shairul’s
whimsical fancies about Islamic laws not being ‘relevant’
anymore in this day and age is a sign of how the liberal Muslims
think. And just because there is no implementation of these laws is not an excuse
to do away with them in totality. They claim that they accept the Qur'an as a
Divine Book and yet they attempt to insult its laws at every juncture. It
certainly sounds very hypocritical to me. As a
Muslim living and residing in Malaysia and one who believe in the
implementation of Islamic values as a way of life, legitimising apostasy
would be detrimental to the Islamic values as practiced by Muslims in
Malaysia. There
should be zero tolerance to apostates and apostasy from Islam, and this should
remain the official policy of the government of Malaysia. |
Man må altså ikke “forveksle religionsfrihet
med rett til å forlate islam”. Neivel, da vet vi hva muslimer legger i begrepet
”religionsfrihet”. Det er rett til å gå over til islam fra en annen religion,
og muligens rett til å skifte mellom andre religioner enn islam også, men ikke
rett til å forlate islam. Selvsagt er det slik, Muhammed var krystallklar på at
det er dødsstraff for frafall fra
islam, og samtlige fire lovskoler i sunni-islam og shia-islam fastslår også
det.
De
overgrep og den undertrykkelse som islam gir seg utslag i for Malaysia sitt
vedkommende er de samme som man ser i andre muslimske land, f eks pisking som
straff for utroskap:

couple caught by enforcement officers holding hands in a public park have been
charged in court with indecent behaviour, local media said today. Ooi Kean
Tong, 22, was charged yesterday for allegedly hugging and kissing his
girlfriend Siow Ai Wei, 20, in a Kuala Lumpur park, the ew
Straits Times reported. Ooi pleaded not guilty to the charge of indecent
behaviour and his case will be heard in court on July 21. If
found guilty, he could face a maximum fine of 2,000 ringgit ($A722) or a year
in jail or both.

wishes legal in Islam

father can coerce his daughter to comply with his wishes to marry a person of
the family's choice and it would be legal and binding in Islam, Kosmo! reported. However, the couple must be compatible with each
other, the paper said, quoting Universiti Malaya professor Datuk Dr Mahmood
Zubdi Abd Majaid.
He said
Islam recognised such marriage because the father is considered the wali mujbir
(authoritative custodian) of the girl. Dr Mahmood, who heads the Fiqh Usul department
of the university's Islamic Studies Academy, said for as long as the woman
remained a virgin, the father would be her custodian.

has urged the government to cancel an upcoming concert by pop diva Mariah Carey

henne kan bare holde seg borte. Mon tro hva dagens politisk halvkorrekte

Two Malaysian states have ordered shopping malls to strip
their halls of Christmas decorations and focus instead on setting the mood for
a Muslim festival that arrives earlier in December, officials said yesterday.
"We are disappointed that they (the malls) are so influenced by Western
culture," Chua Soi Lek, tourism chief in the southern state of Johor, told
The Associated Press.
The action
followed complaints from politicians and commentators in this mostly Muslim
country that many shopping complexes were displaying Yuletide ornaments and
ignoring Eid-Al-Fitr -- the celebration at the end of Ramadan, the holiest
month of the Muslim calendar. Chua said the local government had directed malls
to remove Christmas banners and other frills until after the first week of
December, when Ramadan -- a time of fasting and other forms of abstinence -- is
over.

Malaysia
blir fra tid til annen trukket frem som eksempel på et moderat muslimsk land og
på at islam kan moderniseres til noe menneskelig. Det er i og for seg korrekt
at til muslimsk land å være er Malaysia forholdsvis moderat, men som det
fremgår av oppslagene nedenfor er det ikke ”modernisering” som preger bildet.
Det er snarere tvert i mot, dvs en utvikling mot et strengere muslimsk regime.

KUALA LUMPUR: Women and Family Development Minister Datuk
Shahrizat Abdul Jalil has urged women leaders in the country to join her in
pressuring the Terengganu state government to withdraw its proposed Syariah
Criminal Enactment which encouraged the discrimination of women. She said
certain provisions in the draft of the Syariah Criminal Bill on Hudud and Qisas
(revenge crime restitution) were “grossly unfair” to women.
Section 9
(2) of the Bill states that a woman who alleges rape but cannot provide clear
or circumstantial evidence will be guilty of qazaf (slanderous accusation) and
liable to be whipped 80 times. As proof, the victim must provide four Muslim
male witnesses to the crime or alternatively, get the rapist to make a
confession. Women and non-Muslims, male or female, cannot act as witnesses.
“It is
impossible to provide witnesses because rapes usually happen in quiet and
secluded places,” Shahrizat told reporters at her ministry yesterday.

approval of the ''hudud'' penal code by the legislative assembly in
opposition-controlled Terengganu is raising the spectre of extremism in
multi-ethnic Malaysia as the nation's moderate leader prepares to step down in
2003. The measures being pushed through
by the Parti Islam se-Malaysia (PAS) cannot become common law as long as Prime
Minister Mahathir Mohamad's coalition controls the country and defends its
constitution, legal experts say. Muslims are only narrowly in the majority
nationwide, but PAS dreams of turning Malaysia into a conservative Islamic
state some day, and the party sees the hudud as a step to this.

women this year for not wearing religious headscarves. The women were mostly
workers in restaurants and food stalls in Kota Bahru, 540 kilometers (335
miles) northeast of Kuala Lumpur, city public relations officer Azman Mohamad
Daham was quoted as saying by Malaysian newspapers Friday.

advertisement guidelines is to curb the spread of immorality among the people,
said PAS spiritual advisor Datuk Nik Aziz Nik Mat. “Yes, we have asked Muslim women to cover up,
while non-Muslims should dress decently. When there is no display of
provocative behaviour, there is also no bad example for others and the young to
ape,” he said when asked about the latest controversy arising from the Kota
Baru Municipal Council’s order for some shops to remove print advertisements
that contain pictures of “uncovered” women, some of whom were in provocative

NON-Muslim women in the private sector in Terengganu will
not be allowed to wear short-sleeved blouses, tight-fitting jeans, long skirts
with slits or mini skirts during working hours soon. They should also not wear
other figure-hugging or revealing dresses. "The Pas Government will not
tolerate females, including those from different religions, wearing such
clothes during working hours," Ladang State Assemblyman Dr Sulaiman
Abdullah said yesterday.
The Kuala
Terengganu Municipal Council president said Muslims in the private sector would
have to adhere to the Islamic dress code which would require them to use
scarves and wear loose clothes. The KTMC will distribute circulars on the dress
code to businesses and employers with those failing to adhere
risking loss of licence or a maximum compound fine of RM250.

til islam, men som “reagerer” på krass språkbruk fra FOMI vil “reagere” når
muslimene vil bestemme hvordan de skal kle seg på job her til lands. Den ENESTE
grunnen til at norske muslimer ennå ikke har kommet med slike krav er at de
ikke står sterkt nok ENNÅ til å gjennomføre det, men det er bare et spørsmål om
noen få tiår.

convert to Christianity was denied permission to have her identity card changed
to reflect her religious conversion. The woman, who has already changed her
name from Azlina Jailani to Lina Joy, was told by a judge that she must take up
the issue with the Islamic Sharia Court. According to a 1976 law, Lina will not
be able to have a Christian wedding ceremony as long as Islam is the religion
reflected on her identity card. As an apostate she also faces possible
"rehabilitation" to convince her to re-embrace the Islamic faith.
January 12, 2001 - A Christian retreat center operated by the
New Testament Church in Bukit Markisa was raided by police. Though admitting
that the church center was a legal settlement and did not pose a threat to
national security, Inspector General Tan Sri Norian Mai, said the raid will
actually help the church by putting an end to allegations against it.

most important holiday, hundreds of thousands of believers in southeast Asia
face the prospect of celebrating Easter without free access to the Bible. In a
decision indigenous Christians in eastern Malaysia have found incomprehensible,
their government in Kuala Lumpur - which considers itself one of Asia's more
successful democracies - has banned the Bible in their native tongue.
The Iban, the largest of 27 indigenous ethnic groups in
Sarawak province on Borneo island, have since 1988 had
access to the entire Bible in their own language, published by the Bible
Society of Malaysia.
But now the
mainly Muslim government's Home Ministry has named the Iban-language Bible as
one of 35 publications it is banning because they are considered
"detrimental to public peace."

The books
were listed in a ministry statement that cited various publication laws and
said the "printing, import, production, reproduction, sale, circulation,
distribution and possession of books listed under the schedule are banned in
the country." Anyone found guilty of breaching the ban faces up to three
years in jail, fines of up to $5,200 or both.

percent of Malaysia's 23 million people are Christians, and most live in the
east of the country. Iban is spoken by more than 400,000 people, members of a

religious school were outsiders. Some came from elsewhere in Malaysia while
others came from neighbouring Singapore and Indonesia. They all had one thing
in common -- a desire to follow a purer form of Islam.
But some,
say police, shared something more -- they took a secret oath of allegiance to
Jemaah Islamiah, the shadowy Southeast Asian militant network blamed for the
Bali bomb blasts. "I suspected something was not right at that
school," village headman Saad Shamin said in Sungai Redan, his kampung or
village on the other side of a hill from the school in the southern Malaysian
state of Johor.
The
madrassah, or school, was shut down after a police raid in January. Villagers
who work in the nearby plantations and factories have expressed shock at the
mention of one familiar name after another in media reports on Southeast Asia's
war on terror. Police investigating the Bali bombings, which killed more than
180 people, most of them Western tourists, say three of the six Indonesian
suspects had a link with the school.
Religious schools 'breeding ground
for future terrorists'

it to place them under its tight control. Privately run religious schools are a
breeding ground for future Muslim terrorists and should be revamped and placed
under strict government control, said an independent Malaysian think tank.
Religious
schools run by individuals or groups linked to Parti Islam SeMalaysia - like
this madrasah in Kuala Terengganu - are said to have become centres for
extremism and intolerence towards other religions. Prime Minister Mahatir
Mohamad says the authorities would no longer assist in "spoiling the
future" of the children by helping such schools to continue.
'The
government must now watch these SARs more closely to ensure their students are
not recruited by terrorist groups. We have in the past neglected them,' said
MSRC executive director Abdul Razak Baginda.

Immigration Department is studying the possibility of disallowing non-Muslims
from employing Muslim maids following reports that some have been asked to
undertake tasks which were against their religion by employers. Its
director-general Datuk Mohd Jamal Kamdi said the measure was being considered
as part of efforts to address weaknesses and problems in the hiring of foreign
domestic helpers.
At present,
non-Muslims are allowed to hire Muslim maids but they are required to sign a
contract stipulating that they will not ask them to handle or cook food deemed
haram by the religion, and that they must also be allowed to perform their
prayers. Muslim domestic helpers must also be willing to work for non-Muslim
employers. Mohd Jamal said although there were rules regarding the hiring of
domestic helpers by non-Muslim employers, there were still reports alleging
that maids were forced to handle pork, and not allowed to perform their
prayers.
"Since
these incidents are occurring, we will have to consider the possibility of no
longer allowing non-Muslims to hire Muslim domestic helpers," he told
reporters after attending the Home Ministry's monthly gathering.

Many
middle-class Malaysians raised eyebrows last week when they heard that the
authorities had refused to grant a political-satire group any more permits to
perform in the capital, Kuala Lumpur.
The Instant Cafe Theatre Company had until then enjoyed a
successful run of its "The 2nd First Annual Bolehwood Awards 2003" -
Bolehwood here parodying the nothing-is-impossible "Malaysia Boleh"
(Malaysia Can) spirit touted by the government in a country where Bollywood
movies enjoy a sizable following. Unfortunately, thin-skinned city councilors -
unelected political appointees of the ruling coalition - failed to see the
humor in the plot for a variety of reasons and stopped the run.
It would be easy to see this as an isolated incident of
censorship by overzealous councilors. But it should also be seen in the light
of city council actions elsewhere in Malaysia. Last month, in Ipoh city, city
councilors fined 30 unmarried non-Muslim couples RM30 (about US$8) for holding
hands in a bid to keep the city "morally clean". (Government concern
and adverse publicity later forced the council to suspend its "no holding
hands" rule.) A new ruling by the Johor Baru city council from this year
requires written approval from Muslim neighbors before seeking a dog license.
In recent weeks, the authorities have also moved to crack down on pirated and
pornographic video compact discs.
All these
moves appear aimed at projecting a certain image of the government as the moral
guardian of society and are probably not coincidental. They suggest that the
government is trying to improve its moral standing among the people, especially
in the light of the challenge that the conservative opposition Islamic party,
Parti Islam Se-Malaysia, is presenting.

Women's groups in Malaysia have reacted angrily after one of
the country's most senior Islamic clerics opposed calls for new laws to protect
women from rape within marriage. Malaysia's official human rights commission
had asked parliament to make marital rape a crime.
However,
the chief cleric or mufti of the state of Perak said that such a move is
against Islam. The status of women in Islamic law is one of the most
fiercely-contested issues in Malaysia. According to the mufti of Perak, women
are subject to their husband's desires. A husband has the right to be intimate
with his wife and the wife must obey, he told one local newspaper. If she
refuses, the woman is "nusyuz" - disobedient.
"If
the wife refuses, then the rule of 'nusyuz' (disobedient) applies and the
husband is not required to provide financial assistance to her," said
mufti Harussani Zakaria. Islamic lawyers have voiced their support for the
mufti, saying that a woman may only refuse her husband sex if he has a sexually
transmitted disease.

Kelantan Mentri Besar Datuk Nik Abdul Aziz Nik Mat has accused women who
wear revealing clothes of giving the impression that they are selling their bodies.
“Women who wear such clothes are contributing to the rise in sex crimes
and that is why I am in favour of any move to curb such dressing,” he told
reporters after launching the Kelantan Reading Festival 2005 here yesterday.
Nik Aziz said he was in favour of a dress code for non-Muslims as it would help
to reduce sex crimes.
He was asked to comment on the proposal by the council here to introduce
a dress code for non-Muslims working in supermarkets. The mentri besar said
talk about the dress code started 10 years ago.
His comments drew flak from various quarters. Wanita MCA chief Datuk Dr
Ng Yen Yen said Nik Aziz's comments showed that he was totally divorced from
reality and his statements showed his ignorance of gender issues.
“I have come to a stage where I have given up (commenting) on what Datuk
Nik Abdul Aziz says. Doesn’t he realise that most sex crime victims are fully
dressed from head to toe and some of them are children?
“Someone with that kind of mindset on gender issues is an obstacle to
the progress of women. Wanita MCA is concerned that he is taking his guidelines
into non-Muslim areas and it is not up to the state to dictate dress codes.”
Kelantan MCA chief Datuk Dr Fong Chan Onn said the party would protest if the
dress code was enforced.
“The move to compel non-Muslims to abide by the dress code is an
oppression of their rights,” he added. Sisters in Islam and Women’s Aid
Organisation volunteer Nabila Nasir said if the way women dressed made them
victims of sexual crimes, then women in baju kurung and headscarves as well as
girls in school uniforms would not be raped and killed.

In
Malaysia, Muslims come under the Syariah judicial system while non-Muslims come
under the civil judicial system. But which system has overriding jurisdiction
when a civil marriage breaks up and a spouse converts to Islam?
SHAMALA
Sathiyaseelan, 30, got married in November 1998 in a Hindu ceremony. Four years
later, her husband left her to marry a Muslim woman.
Upon his conversion, Shamala initiated High Court
proceedings to ask for custody of their two children. Meanwhile, against her
wishes, her estranged husband had converted their children and was able to get
a custody order from the Selangor Syariah High Court.
On April
17, 2003, the High Court issued an order in favour of Shamala. She was given de
facto custody and the husband was allowed to see the children over the
weekends. The husband was also ordered by the High Court to pay RM250 a month
for maintenance and was prohibited from taking the children out of Alor Star,
where they lived.
In
response, the husband went to the Syariah Court to get a separate custody
order. On May 8, the Selangor Syariah High Court granted him a hadanah
(custody) order. Two weeks later, on one of his weekend visits, he took the
children out of Alor Star. He had used a civil court order to get access to the
children and then relied on the Syariah Court order to keep them.
Currently,
the children are with him and Shamala has reasonable access to them. At the
same time, the husband has also initiated divorce proceedings at the Hulu
Langat Syariah Court. As a result, Shamala has been summoned to the Syariah
Court for both custody and divorce proceedings.
However, it
is Shamala's position that as a person of another faith, a Hindu, in her case,
she is not subject to the jurisdiction of a Syariah Court. Clearly, she is at a
disadvantage and faces several forms of discrimination:
1. Despite
being an equal guardian by law, she is deprived of the right to decide the
religion of her children as her husband had converted them without her
consultation and agreement. By law in Malaysia, both parents have an equal
right to decide the religion of their children if under the age of 18. This
applies to all parents, Muslim and non-Muslim alike.
2. She is
deprived of the right to have a say in the custody of her children as the
Syariah Court has predominantly given custody to the converted husband without
taking into consideration the mother's rights.
3. She is
deprived of the right to have a say in the dissolution of her marriage as
divorce proceedings can be initiated in the Syariah Court without her
attendance or participation.
4. She is
subject to the jurisdiction of a judicial system that has no jurisdiction on
non-Muslims.
Last week,
the High Court found Shamala's ex-husband in contempt of court for violating
the custody order and has ruled that he return the children to her. This is the
reality of Malaysia's double legal jurisdiction. And Shamala is not alone.
Countless of non-Muslim women whose husbands have converted to Islam have had
their rights violated in areas like custody, maintenance and equal access to
the law.
Non-Muslim
mother denied justice

The Malaysian Federal Constitution 3(1) states that, ‘Islam is the
religion of the Federation; but other religions may be practiced in peace and
harmony in any part of the Federation. In Shamala Sathyaseelan vs. Muhammad
Ridzwan Mogarajah; Mogarajah had converted his two children aged two and three
to Islam after his own personal conversion. Justice Faiza Thamby Chik had
referred the case to the Syariah Court and eventually delivers a verdict in
favor of the Muslim father. Justice Faiza also claimed that the father had the
capacity to convert the children to Islam because:
a) The wife did not challenge his own conversion nor seek a divorce when
he converted; and
b) He is the natural father of the said children and a Muslim.
Justice Faiza concluded by claiming that only the Syariah Court has the
capacity and expertise to hear this case and therefore, the mother should take
her application to the Federal Territory Religious Council. This is an unwise
judgment due to the following points:
a) It is a violation of the basic religious rights of the non-Muslim
minority in Malaysia.
b) It contradicts Section 5 of the Guardianship of Infants Act.
c) Malaysia’s ratification of the Convention against All Forms of
Discrimination against Women and the Convention on the Rights of the Child is
not being observed and practiced by the Malaysian judiciary.
d) It enables a disgruntled father an
easy way to gain custody of his children by only converting to Islam.
e) The lack of protection to the non-Muslim female citizen to fight for
the legal custody of her children as the non-Muslim mother has no legal locus
standi to seek relief under Syariah law.
Islam is a social justice system, but the Malaysian judiciary system,
has conveniently denied justice to this non-Muslim mother in her struggle for
custody rights. This has created the circumstance of
forcing the non-Muslims to accept the judgment of the Syariah Court.
This is not what the Malaysian constitution meant. In Shamala Sathyaseelan vs.
Muhammad Ridzwan Mogarajah case, Justice Faiza failed to recognise:
a) The motives of Mogarajah’s conversion to Islam. If Mogarajah
converted purely for child custody, then judgment should take this into consideration.
b)That the custody case of the children should be
heard by the court after the parent’s divorce proceedings or before the
conversion of Mogarajah to Islam.
c) That the Syariah Court should not be involved in cases
that involves inter-faith family law.
d) That although there is no law governing non-Muslim parental and
religious rights in Malaysia, the courts need to exercise wisdom and analyse
such cases rather than conveniently passing their responsibilities to the
Syariah Court.
Denne
historien er verdt å merke seg. Før eller senere vil muslimene forlange Sharia
innført i Norge. De vil helt sikkert først si at det kun skal gjelde muslimer,
så det er ikke noe å frykte for ikke-muslimer. Denne historien illustrerer det
meningsløse i å ha to rettsystemer som man har i Malaysia. I stedet for to
rettsystemer blir det i praksis ett system for URETT, som alt som har sitt
opphav i islam.

non-Muslim ministers have withdrawn a controversial memorandum which called on
Prime Minister Abdullah Ahmad Badawi to protect the rights of religious
minorities, local media said. Eight of the cabinet ministers who submitted the
unprecedented memorandum -- which critics say constituted a breach of protocol
-- have withdrawn it, with only one signatory remaining non-committal, said the
New Straits Times.
"As
advised by the PM, submitting the memo is procedurally inappropriate. Following
his advice, we have withdrawn the memo," Housing and Local Government
Minister Ong Ka Ting said in a joint statement to the official Bernama news
agency....
The
ministers came under fire from several colleagues at Wednesday's weekly cabinet
meeting after they submitted the memo, which calls for a review of laws and the
constitution where they infringe on minorities' rights. Their unusual move
followed the controversial Muslim burial of well-known mountaineer M Moorthy
over his Hindu wife's protests, which sparked outrage among religious
minorities.
Moorthy was
found to have converted to Islam by a sharia court in which his non-Muslim wife
had no say. A civil court later refused to rule on the religious court's
findings. Abdullah said he met several of the non-Muslim ministers at his
residence over the weekend to convince them to retract the memorandum.
"At
the meeting, I said they should withdraw the memorandum and they agreed,"
Abdullah was quoted as saying by the New Straits Times. "When we are
members of the same team there is no restriction on what we discuss and talk
about. Use this opportunity to the fullest. We are all in one team, have one
goal, one ambition and a way to discuss," he told Bernama.
On Friday
he called for calm over the issue, warning the country's political stability
could be threatened if tempers frayed. Religious minorities in mainly-Muslim
Malaysia say non-Muslims are increasingly losing out in legal disputes to
Muslims, whose matters are heard in sharia courts in the country's dual legal
system.

The biggest summit of Islamic
leaders in three years opened Thursday with calls for the world's 1.3 billion
Muslims to unite against "a few million Jews" who allegedly rule the
world by controlling the major powers.
Malaysian
Prime Minister Mahathir Mohamad said Muslims for years believed mistakenly that
Islam rejected new technology and progress. He urged Muslims worldwide to
ignore teachings by religious fundamentalists that scientific studies are
somehow un-Islamic.
"We
need guns and rockets, bombs and warplanes, tanks and warships for our
defense," Mahathir told leaders from 57 nations gathered for a summit of
the Organization of the Islamic Conference in Malaysia's new capital,
Putrajaya.
"But
because we are discouraged from learning of science and mathematics ... today
we have no capacity to produce our weapons for our defense," said
Mahathir, chairman of the two-day summit.

Municipal Council (MPKB) by March. He said a steering committee had been formed
to prepare a concept for an “Islamic City” that was acceptable to all races.

impose a condition for new buildings in the town to feature Islamic

I den grad de profesjonelle og islamofile yrkesløgnerne som
kontrollerer det meste av nyhetsformidling i Norge og Vesten for øvrig vier
Malaysia i alminnelighet, og islam i Malaysia i særdeleshet, noen oppmerksomhet
er det typisk som eksempel på et såkalt ”moderat” muslimsk land. Nå er dette
selvsagt relativt. Sammenligner man Malaysia med for eksempel Saudi-Arabia
eller Pakistan kan man med en viss rett betegne Malaysia som moderat. Hvis
derimot et såkalt ”kristent” land hadde praktisert det å være kristent på samme
måte som Malaysia praktiserer det å være muslimsk ville vedkommende land
umiddelbart blitt stemplet som ultraekstremistisk. I det øyeblikk man legger
samme målestokk på noe som helst muslimsk som man bruker på noe som helst sivilisert ( dvs ikke-muslimsk) forsvinner islams
eksistensberettigelse som dugg for solen for ethvert noenlunde mentalt
oppegående menneske.
Den 30 2007 hadde både Magazinet, Dagen og
til og med Islamposten
en historie som til fulle illustrerer det. I korthet handler historien om en
kristen kvinne i Malaysia som 30 mai 2007 tapte sin
lange kamp for å få konverteringen fra islam offisielt godkjent. Lina Joy har i seks år kjempet
for å få fjernet ordet islam fra identitetskortet sitt, men onsdag bestemte
retten at slike avgjørelser må tas av religiøse sharia-domstoler.
Hvis man et øyeblikk transplanterer denne saken til Norge gir det
grobunn for en del refleksjoner. La oss forestille oss en norsk kvinne, født
inn i en kristen familie og døpt i Den norske kirke. I voksen alder konverterer
hun til islam. Bare tanken på at religiøs tilhørighet skal stå i passet ville
vært nærmest utenkelig i Norge. Men om det nå gjorde det ville tanken på at hun
skulle måtte gå rettens vei for å få det forandret fra ”kristen” til ”muslim”
ville vært enda mer utenkelig. Og at en norsk rett på toppen av det skulle
nekte henne å få dette forandret ville ha reist ikke bare en storm, men orkan
av protester både fra muslimene og fra den islamofile ormeyngelen.
Men i et muslimsk land kan dette skje, og de motbydelige klysene av
karbonbasert spesialavfall som forfattet artikkelen som Norsk Taqiya Byrå (NTB)
sendte ut om saken kaller landet MODERAT! Og tilhengerne av denne perverse
dødskulten skal liksom lære OSS noe om toleranse og mangfold.

Å tolerere dette intolerante og perverse svineriet på norsk jord er å
bidra til at vi får malaysiske tilstander her også på veien mot det som verre
er, f eks pakistanske tilstander.
Den 30 august 2007 feiret Malaysia
50-års dagen for sin såkalte ”uavhengighet” fra Ummah Kingdom
(bildet til venstre). Til stede var selvsagt også en representant fra emir-familien
i Londonistan,
nærmere bestemt ”prins” Andrew. Samtidig med dette forbereder landets regjering
diskusjoner om forandringer som vil revolusjonere landets (u)rettsystem ved at
muslimsk lov (Sharia) vil bli innført i langt mer omfattende grad enn hva
tilfellet er i dag.
Nå har
faktisk Malaysia allerede en form for kvasi-sharia ved at man har både sekulære
domstoler og sharia-domstoler. Det som sorterer under sistnevnte er først og
fremst familie(u)rett, dvs skilsmisse og arvesaker, og da i utgangspunktet kun
for muslimer. Dette har imidlertid fungert dårligere og dårligere i praksis ved
at saker hvor partene er både muslimer og ikke-muslimer havner i
sharia-domstoler, og ikke-muslimer dermed blir dømt etter sharia-lover. Det var
selvfølgelig å legge grunnsteinen til et slikt system det satans
sharia-ludderet Erna Solberg også var ute etter da hun i sin tid som statsråd for partiet for terror, apartheid og
etnisk rensning presset på for
å opprette sharia-domstoler i Norge.
Og nå vil
man altså ta skrittet fullt ut i Malaysia og innføre sharia på bred basis.
Dette skaper naturlig nok stor frykt og uro hos det ikke-muslimske mindretallet
som består av både
hinduer, kristne og buddhister, og som til sammen utgjør ca 40 % av
befolkningen. Initiativet til innføring av ”full sharia-pakke” kommer fra
landets høyesterettsjustitiarius, Ahmad Fairuz. Statsminister Abdul Badawi
benekter også at Malaysia er en sekulær stat, og en talsmann for Det islamske
parti ønsket forslaget om innføring av sharia velkommen. Han la imidlertid til
at høyesterettsjustitiarius sin jobb var å anvende lovene, og ikke å lage dem.
Malaysia
blir jo gjerne fremstilt som et såkalt ”moderat” muslimsk land. Sammenlignet
med f eks Saudi-Arabia,
Iran og Pakistan er det,
eller har det i det minste vært, det. Men som utviklingen viser, både i
Malaysia og andre såkalt ”moderate” muslimske land, skjer det en radikalisering
av muslimene også der. Og her er det viktig å presisere at det er muslimene
som radikaliseres, det er ikke islam. Islam ER radikal i utgangspunktet,
radikalt intolerant, radikalt voldelig og radikalt undertrykkende, kort sagt
radikalt jævlig.
Når muslimer radikaliseres betyr det ikke noe annet enn at de begynner
å ta islam mer på alvor. Og det er altså trenden i en rekke land som, ikke uten
en viss rett, har vært betraktet som ”moderate”. Dette rimer selvsagt ikke i
det hele tatt med det den islamofile ormeyngelen forsøker å innbille oss om
”modernisering” av islam. Uttykket er for øvrig komplett idiotisk. Muhammed var
islams siste profet og Koranen er Allahs siste og endelige ord til menneskeheten
inntil dommedag. Islam har selv låst døra for modernisering og smeltet om
nøkkelen.
Under
påvirkning av vestlig sivilisasjon i kolonitiden kan man si at muslimene til en
viss grad er blitt ”modernisert”, men som tilfellet med Malaysia illustrerer,
når de overlates til å styre seg selv går det bakover igjen.

”moderasjon”
Land som Egypt, Indonesia og Malaysia fremstilles og omtales gjerne som såkalt ”moderate”
muslimske land av yrkesløgnerne i sharia-sensurerte halal-medier i Norge og
andre vestlige land. Nå er det selvsagt en viss forskjell på disse landene og
land som Saudi-Arabia,
Iran og Pakistan. Men hvor stor er forskjellen egentlig, og kanskje like
viktig, hvordan utvikler situasjonen seg, blir avstanden større eller mindre
til land som selv den islamofile ormeyngelen ikke tør å omtale som ”moderate”?
Skjer det en radikalisering, eller skjer det en moderasjon ?
Før man går nærmere inn på det er det en ting
som er svært viktig å presisere i slike sammenhenger. Når det er snakk om
radikalisering er det alltid muslimene som radikaliseres, ikke islam. Islam
er radikal i utgangspunktet, radikalt aggressiv, radikalt voldelig, radikalt
intolerant og radikalt undertrykkende, kort sagt radikalt jævlig.
Ikke alle som kaller seg muslimer tar
imidlertid alle sider ved islam like alvorlig til alle tider og steder. At
muslimer radikaliseres innebærer kort og godt, eller rettere sagt kort og
vondt, at de tar islam mer på alvor, at de så og si blir mer muslimske. Når det
gjelder Malaysia har det i lengre tid pågått en klar radikalisering av
muslimene, en radikalisering som har gitt seg utslag på mange vis.
Den nordlige provinsen Kelantan (markert med
rødt på kartet til venstre) er regjert av det såkalte Pan-Malaysian
Islamic Party. Der ble det for en tid tilbake
innført en lov som påla supermarked å ha separate kassakøer for mannlige og
kvinnelige kunder. Dette skulle angivelig være for å
”beskytte” kvinnene. Hvis ikke muslimske malaysiske menn kan stå i en kassakø
sammen med kvinner uten å trakassere eller klå på dem sier det i tilfelle mest
om muslimske menn. Det
er neimen ikke rart om de da går bananas med voldtekter når de kommer til
Vesten.
Uansett har supermarked i det nordlige
Malaysia ikke tatt loven om separate kassakøer særlig alvorlig. Men det blir de
nok pent nødt til å gjøre nå. De lokale myndighetene har nemlig kunngjort at
denne loven nå vil bli håndhevet langt strengere, og supermarked som fortsetter
å ignorere den kan vente seg kraftige bøter.
Dette er for øvrig bare ett av mange tegn på
radikaliseringen i Malaysia. I midten av desember 2007 konfiskerte myndighetene
kristne barnebøker fra flere bokhandlere. Begrunnelsen for konfiskeringen var
at bøkene inneholdt bilder av Moses og Abraham. Begge er såkalte ”profeter” i
islam, og å avbilde dem er dermed i strid med muslimsk lov.
De fleste har vel fått med seg at det er i
strid med muslimsk lov å avbilde Muhammed. Det muslimske billedforbudet stopper
imidlertid slett ikke der, selv om det først og fremst er det muslimene har
kjørt på i Vesten. Islam gjør egentlig ”krav” på alle profeter i Bibelen,
inklusive Jesus som islam betrakter som en profet, og ikke som Guds sønn. Når
det slås ned på avbildninger av bibelske profeter selv i et såkalt ”moderat”
land som Malaysia er det nok bare et spørsmål om tid før kristne også i Vesten
må regne med å bli angrepet av muslimer for avbildninger av Jesus og andre
bibelske personer.

det viser altså kvinnelige studenter i Kota Baru, provinshovedstaden i Kelantan , den nordlige grenseprovinsen mot Thailand.
Provinsen var for øvrig en del av Thailand frem til 1948 da området ble avstått
til Malaysia.

Avslutningsvis
er det nok et forhold ved Malaysia som bør trekkes frem, som også ble påpekt
når det gjelder Egypt. Malaysia er et populært turistmål, og turistreklamer for
landet er en gjenganger på diverse fjernsynskanaler, bl a CNN. Som
turistreklamer flest prøver de å lokke folk til landet ved å vise frem hva de
har å by på også av folkeliv og kultur. Til tross for at 60%
av befolkningen er muslimer et det INTET av det de der prøver å lokke folk med
som er av islamsk opprinnelse. Buddhisttempler som bringer tankene hen på ”The
Road to Mandalay” vises gjerne frem, men sjelden eller aldri moskeer eller noe annet islamsk.

Slik
presenterer gjerne Malaysia seg i turistreklamen. Ikke mye av islamsk
opprinnelse der, tvert i mot det er forbudt etter islam (Bildet til høyre er
fra hinduistisk dukketeater). At islam
ikke brukes når landet skal presenteres utad er ikke så rart. Hva er det islam
har å bidra med ? Jo, ødelagte kirker, pisking, terror, ”røde roser” og
skilsmisse pr SMS !
